The next part is caught on home security camera. Rice was driving home after the stabbing. He was actually on his own street in Grand Ledge when an Eaton County Sheriff's Deputy pulled him over. You can see rice coming towards the deputy and not stopping. MSP says he had the knife in his hands. That deputy, she's been with her department for nearly 23 years. She opened fire at least nine times. MSP says to protect herself. Killing rice. She opened fire at least nine times. Cover the deputy's weapon. You've been here multiple rounds fire. Yes, the bit bizarre that you'd stop and pick something up while somebody's firing at you repeatedly. Let's talk about the 77 year old who was stabbed. The sheriff just updated his condition as serious right now. Sean Rice, the man he was shot by the sheriff's deputy does have a criminal record. He did time for home invasion bottom line here. Guys, people absolutely stunned by what happened here over a mask back to you. Well, a mask are on so many people's minds right now. Sean, we know this has been actually leading to a lot of nine one one calls right now because of it. Yeah, yesterday Governor Whitmer's day one of her ramped up mask up campaign and different dispatch centers around Metro to where we're flooded. We've been listening to some of those calls this afternoon will place on for you at six o'clock and tell you what different police departments how they're responding. We're not responding to all those calls. Yeah, all right. Sean, we will see you again at six. Now, it's day two of Michigan's mask up rule being in effect. A lot of people, including law enforcement, still trying to figure all of this out. Some shoppers haven't hesitated to call 911 at the first sign of someone not wearing a mask. But as local court defender Sean lay shows us once you reach police, your mileage may vary on the mask enforcement. Well, here we are. It's day two of Governor Whitmer's new ramped up orders to mask up on day one. Plenty of people called 911 to call out others for not wearing masks like when this woman saw a large crowd at a local park. Nobody social distancing and nobody's wearing masks living in St. County 911 getting a lot of calls from people reporting others not wearing masks on Monday or being in a business where no one was wearing masks on Monday. And nobody has a mask on inside. How? How do a single person does? And apparently the sheriff isn't enforcing that our office received a ton of calls yesterday. Livingston County Sheriff Mike Murphy has made it clear. He is not sending deputies to calls about masks. He says since the state reopened, emergency calls are actually up way up. He wants his deputies on those emergencies. Frankly, you know what the governor wants is aggressively enforced. She has the state police that heard disposal and I hate to throw them under the bus. I love those guys. But you know, at the end of the day, the colonel reports to her. I report to the voters in Limxton County. We checked with other departments to Troy police not responding to calls about masks, referring calls to the health department. Oakland County responded to eight calls for no masks on Monday when deputies arrived. Masks had been put on. Royal Oak, no calls at all. Police say they'll remind people about the order to wear a mask. Sheriff Murphy says that all comes down to this. I could keep a staff busy. Probably 10 deputies, nine stop mask violations, just based on the number of calls that we got yesterday. But we begin with a violent argument over a face mask that turned deadly. They were at the quality dairy in Diamondville. The fight was over one man not wearing a mask. That man pulled out a knife and stabbed a 77 year old before taking off. Seven action news reporter Jim Kerchner with what happened next. This is a screenshot of the body cam video you're about to see. But let me draw your attention to what the sheriff's office says are three weapons. You can see a screwdriver in one hand and what appear to be two knife plates in the other hand. This man is identified as 43 year old John Ruiz. He had these in his hands as he's rushing the deputy and then she opens fire. Drop it. Drop it. Drop it. Drop it. Drop it. Drop the gun. Drop the weapon. Drop the weapon. It's very unfortunate she had to use her weapon but she saved her life. I mean that's the most important thing right here. She had to use deadly force and she did it properly. It was 6.45 this morning when state police say that man entered the quality dairy in Diamonddale Southwest of Lansing was not wearing a mask. The sign on the door says masks are required. Sean Ruiz was denied service a 77 year old man a customer from Lansing had words inside the store over this and he was stabbed with a knife by Ruiz according to state police. The 77 year old remains in serious condition minutes later in nearby Delta Township state police in the county sheriff respond to a call to 911 with the description of the car and that man. This doorbell video is also released showing how Ruiz gets out of his car slowly then rushes the deputy who fires several shots Ruiz dies later in surgery. This major mask incident now a requirement from the governor taking tensions to a high level. It is what it is the governor put it out. But sure I mean a lot of local police departments even the sheriff's departments have to deal with with complaints. So we'll deal with the new face for joining us. I'm Emily Leonard and I'm Tom Hillen. First at noon a man was shot and killed by police this morning after he stabbed a man and it all started with an argument over wearing a face mask. The man who was killed wasn't wearing a mask at quality dairy in Diamonddale near Lansing. He was confronted by another man who he stabbed after the stabbing the 43 year old grandledge man took off to a nearby neighborhood where he was met by authorities. The man pulled the knife on an eaten county deputy who then opened fire. She is retreating ordering him to put his weapon his knife down and backed up and at that time she defends herself from being attacked with that knife she shoots that suspect. The suspect died at a nearby hospital. The man who was stabbed to 77 years old he's at a hospital in stable condition. The deputy has been with the eaten county sheriff's department for more than 20 years. State police are handling the investigation. How does the deputy's weapon you can hear multiple rounds fire? The maskless man allegedly pulled a knife and stabbed the other man before fleeing the scene. Whitney? Well Brian and Sue police identified that suspect as a 43 year old. You notice something here too? It's like what did we see before? Well we saw the whole thing being mapped out. So you can't even like you know this is a police scene. You're not supposed to drive in there. But then when they flip to the reporter here you don't see any of that. You don't see any police tape. You just see cars parked. You see the dairy co here. Right? So what's going on right away? Well Brian and Sue police identified that suspect as a 43 year old as Shawn Ruiz they say at the time of the incident he had three weapons in his hand, two knives and a screwdriver. Three weapons in his hand, three weapons in your hand, three in one hand, even in two hands, three weapons. Does that make sense to you? Two knives and a screwdriver? Anyways. Okay. So this is the alleged incident here and think of the the themes that have been playing out with the police. This is a white person right by the looks of it here. And they've been pulled over here by the police and some what looks like a very quiet suburban area here and somebody is filming this. If this is now could be somebody's you know ring if you know the surveillance door cams but it looks like it's coming from somebody's camera here from the garage as you see what appears to be some sort of either recycling ban or something here. It's released this video of the incident this afternoon and it you can see the officer attempt to pull release over. Release immediately gets out of his car and begins approaching the officer who is yelling for him to drop his weapon. Body can footage of this exact moment shows release begin charging. Yeah that's it's very intelligent. It would make a lot of sense that you would have these weapons in your hand like a screwdriver. And two knives or whatever they say and you would have an officer pointing a gun right at you and instead of doing what the officer says you start to move forward to attack the officer. It makes total sense doesn't it YouTube community? Doesn't this make sense? Doesn't this seem like it's a legit story to you? So let's just watch it here. Again you know if you were a discretion advised I'm not trying to show any violence but I haven't seen any violence in this video so I mean if somebody can show me that there's violence that actually occurs then. Not I don't really I mean I hear something that maybe could pass as a gun shot sort of thing but I don't see any evidence of shots being fired maybe blanks but I don't know. Began charging the deputy. And you can see right there that it appears that the gun fires. You see yeah you see the the lever pull back on the gun sort of thing so where's the blood where's the bullets where's the casing just a question Eden County here sheriff would it make sense to you I mean unless you've completely gone off your rocker and you're crazy and you're suicidal then yeah I guess maybe in that case you might want to run at somebody who's pointing a gun at you at point blank range but otherwise that would be pretty suicidal and extremely stupid would it not be and he maybe he just wants to fix the gun here saying that's not a real one I've got my screwdriver here maybe we can get in there and fix it up or something I don't know because he's got a screwdriver and he's got whatever he's got in his hand there. Carging the deputy police say yeah and you like just see here when you see the the cock here going back pulling back sort of thing right I just want you to see if you can spot that right there you can kind of spot that so it appears that but there's somebody squeezing the trigger here which is causing the gun to fire back sort of thing but we don't see any evidence of bullets on the victim or the the assailant.
