In the last two hours, the embattled rookie cop seen here turning himself into police. James Brennan is now facing two charges in the shooting of Eric Kuntus and another teen. Now to San Antonio where the city's police chief decided not to wait for a grand jury and charge an officer for shooting an unarmed teenager. The deputy officer James Brennan was fired and we're learning he turned himself into police last night. The former San Antonio police officer who shot and wounded a teen driver in a fast food parking lot has been charged with aggravated assault. That's a felony. James Brennan turned himself in last night. He was taken into custody. He faces two counts of aggravated assault by a public servant. He then had to take a mug shot. The 27 year old was trying to make bonds totally $200,000. He obviously made them because he's out of jail this morning and doing court right before thanks giving on November 23rd. He was stripped of his badge a week later. He is facing charges former San Antonio police officer James Brennan began the booking process about three hours ago. His mug shot just released. Brennan was seen shooting a teen at a local McDonald's parking lot earlier this month. The night teams John Paul, but our house has been following this story and John Paul. There are two charges that Brennan is facing tonight. Steve Stephanie, that's right. James Brennan faces two counts of aggravated assault by a public servant. Each of those accounts or accounts are for the two people in the vehicle that night. A 17 year old girl who was not injured and 17 year old Eric Gandu who is still in the hospital and on life support. This body cam video is what led to the firing and now rest of James Brennan. And shows the now former San Antonio police officer approved to car and opened the door without warning. The driver 17 year old Eric Gandu put it in reverse and tried to drive away. Investigators say Brennan fired 10 shots. Gandu is now in the hospital fighting for his life. George Ramos, a friend of Gandu's, recall seeing the video. It broke my heart. I thought while was at school. He has big goals in his life. He's never had bad intentions of ever doing anything. He's always had big goals. He was our comedian of the group. He still is. And we're just praying and hoping for the best. The Gandu family has put out this statement about Eric that reads in part. He is still unconscious and is on life support. We like to correct any misrepresentation that Eric is in stable condition or he is going to be fine. That is not true. Every breath is a struggle. Just a few hours after protesters gathered to call for changes against Brennan. In a tone of police chief William McManus announced the once probationary officer was in custody. This was a failure for one individual police officer. It had nothing to do with our policies. Policies did not allow that. Our training did not does not teach that. So this was a fail for one particular police officer. Chief McManus explains this is still an active and open investigation. He doesn't have a timeline on when it will wrap up. And for that reason, the case has not been turned over to the DA to turn in for to the grand jury. He adds the most important thing for him was to get Brennan off the streets that they have accomplished that at public safety headquarters. Al-Bara has case that. That's what they call them. Police shootings and this is no different. This case will be reviewed. That division will make a recommendation to the DA. Should he decide to put it before a grand jury? This morning, man was rushed to the hospital after police say they had to shoot him because he hit an officer with his car. All of this happened just before 10 30 last night near the McDonald's at Blanco and West Avenue. Katrina Weber is near Blanco and West Avenue where it all happened and says administrative duty is the routine procedure in cases like this when officers fire their guns. The officer was answering a different call at the time when he noticed that car after 10 30 last night. McManas says he went to talk to the driver and then the driver took off hitting the officer in his leg with the car. Once he was struck, he drew his firearm at far multiple times into the car, striking the driver. That man was taken to a hospital and the last word we had, he was still in surgery. So as far as we know, he is still in the hospital. The officer who the chief says has been with the department for a little bit more than a year. A San Antonio Police Officer terminated after a shooting involving two teens Sunday night in a north side parking lot. SAPD released body cam footage of the incident that happened around 1045 Sunday night in a McDonald's parking lot off Flanko Road. We are learning tonight that officer had only been on the force for seven months and still on probation. Chief William McManus talked to Ken's fire reported Vanessa Croix defending the department's decision to fire that officer. Vanessa joins us live now from where that shooting happened. However they're small enough that they're not going to make a deeper life threatening wound. And that has saved a lot of people in car accidents. It's also allowed rescue workers to break a window out and pull people out of the car when they need to. That's designed so that if it's broken it'll shatter into thousands of little pieces. If you had a windshield that was made of the same safety glass that the side windows are, then when you're driving down the highway and a rock kicks up and hits your windshield it might shatter the whole thing. The sandwich configuration makes the windshield easy enough to crack and it's hit by a big rock but very resistant to breaking. It'll shatter into thousands of little pieces. Like that! The driver identified as 17-year-old Eric Cantu and his passenger, a 17-year-old female, were located a block away at Parliament and Blanco Road. Both had already exited the vehicle. Cantu was charged with evading detention in a vehicle and assault on a peace officer. And he was shot at least twice in the head. He was there for a disturbance at the McDonald's. He was distracted by a vehicle that he believed he saw the previous night and tried to stop but it evaded. And then he decided to go over and approach that vehicle. As you can hear in this video, officer James Brennan believed the car was stolen and called for backup. Can you start me one more? I got a vehicle over the head that I was fed for me the other day. However, Brennan did not wait for backup. Walked up to the vehicle, opened the door and told Cantu to get out. After the car moved in reverse, Brennan opened fire. Brennan was placed on administrative duty following the shooting Tuesday. And he was shot at least twice in the head. He was shot twice in the head. He was fired for violating the department's tactics and procedures. Well, it started with the tactics he used to approach the vehicle. That was number one. Number two, it was shooting at the vehicle both at the very beginning of the video and then later the second volley. But both against policy shooting at vehicles unless it's in the ultimate defense of your life or someone else's. Brennan was a probationary officer who had just graduated the police academy and had been on the police force for seven months. Pickman says he was qualified to patrol on his own. City manager Eric Wall shanned the mayor weighing in on the incident saying it's clear that the officer's actions were in violation of the training and tactics that officers use every single day. And says he supports the chief's decision. Mayor Ronnerberg adding that officers actions ran counter to SAPD's mission and character and says he is relieved quick action was taken by the chief to terminate Brennan. We are learning the victim was taken to an area hospital where told he is expected to be okay and its charges are pending.
